All of James Russell Miller’s works are out of copyright, so you are free to copy and distribute them as you feel fit.
In the USA, all works published before 1923 are out of copyright. In Canada and the UK the rule is 50 years after the death of the author. Which means 1962 in the case of Dr. Miller. For works nor yet out of copyright, these rules have been undergoing revision, so don’t apply these guidelines to other authors or countries.
Miller took snippets of poems, rarely if ever quoting the full poem. It is safe to publish whatever Miller published, provided you do so in context. In the United States the situation is simple: all of the poems are out of copyright.
In the UK, Canada, and other British Commonwealth the situation is more complex. The poet might not yet have been dead for 50 years, so the full poem might still be in copyright in these counties. To be safe check the date of when the poet died before publishing.
When you are publishing on the Internet, you have the interesting question of where the publishing actually takes place. Is it where you live, where the server is physically located, or where the head office of the Website hosting company is located? If you know the answer to this, please let me know.
